Please read these Terms of Use ("Terms") carefully before using the Portix("App"), you are agreeing to be bound by these terms of use, and all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using the App. The materials contained in this App are protected by applicable copyright and trademark law.

1. License:

Permission is granted to temporarily download one copy of the materials (information or software) for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Portix at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

2. User Obligations:

a. Age Restriction: You must be at least 13 years old to use the App. If you are under the age of 18, you represent that you have obtained parental or guardian consent.

b. Account Creation: To access certain features of the App, you may need to create an account. You agree to provide accurate and complete information during the registration process and to keep your account credentials confidential.

c. Prohibited Activities: You agree not to engage in any activity that may:

Violate any applicable laws or regulations.

Infringe upon our intellectual property rights or the rights of others.

Interfere with or disrupt the operation of the App.

Upload or transmit any content that is unlawful, offensive, or harmful.

Intellectual Property:

All intellectual property rights in the App, including but not limited to copyrights, trademarks, and trade secrets, belong to us or our licensors. You may not use, copy, or distribute any portion of the App without our prior written consent.

3. Disclaimer of Warranties:

The App is provided on an "as-is" and "as-available" basis. We do not warrant that the App will be uninterrupted, error-free, or secure. We disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement.

a. The materials within Portix App are provided on an 'as is' basis. Portix makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

b. Further, Portix does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials within the app.

4. Limitation of Liability:

In no event shall Portix or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App and the materials within Portix, even if Portix authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Indemnification:

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or your violation of these Terms.

6. Governing Law and Disputes Resolution:

Except to the extent that: (i) any applicable additional terms incorporated into these Terms provide differently, or (ii) the applicable laws and regulations of your jurisdiction mandate otherwise, the Agreement and any dispute or claim arising out of or in connection with the Agreement will be governed by the laws of the People's Republican of China. Any dispute, controversy or claim (whether in contract, tort or otherwise) arising out of, relating to, or in connection with the Agreement, including their existence, validity, interpretation, performance, breach or termination, will be referred to and finally resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC), and the place of arbitration shall be in Beijing. Within the valid period for the arbitration, such arbitration tribunal shall be subject to the arbitration rules of the CIETAC in effect at the time of the arbitration. The award of the arbitration tribunal shall be final and binding upon the two parties.

7. Modifications:

We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the revised version within the App. Your continued use of the App after the changes constitutes your acceptance of the modified Terms.
